Thank you for using our chatbot creation service Botsurfer (Service).
The Service is provided by PS:Digital Ltd (the Company), a company based in the European Union.


By using our Service, you agree to these Terms.


Please read them carefully.

By using our Service, you do not acquire any ownership rights in the intellectual property of our Service or in the content provided through the Service, such as tutorials, videos, etc. These Terms also do not grant you any right to use the marks or logos used in our Service. Do not remove, obscure or alter any legal notices displayed on or with our Service.

We may send you service announcements, administrative messages and other information in connection with your use of the Service. You may opt-out of some of these notices.

You may not use the Service in violation of any law or regulation within Slovakia, the European Union or your country of residence.

The Company may, in its sole discretion, terminate the accounts of users who violate the Terms of Service.

The Company reserves the right to change or expand the Terms of Service without notice; the updated Terms will be valid and effective when posted on a prominent page of the Service.

Fair Use Policy

There are certain limitations on the features of the Service that are technical or cost-related in nature and must be adhered to for the sustainability of the provision of the Service to all Users.

The Company reserves the right to temporarily or permanently discontinue/restrict the provision of functionality for a particular page/chatbot on the Service or for an entire user account on the Service.

Circumstances that may result in a restriction of the Service under the principle of fair use:

1. If the number of chatbots created exceeds 50 per user account. In this case, a review of the fees for future use of the Service or termination/limitation of the provision of certain functionality may apply.
2. If the number of unique conversations for a particular page/chatbot exceeds 10,000 per month (PRO plan). In this case, a review of fees for future use of the service or termination/limitation of certain functionality may apply.
3. If the cost of using the GPT API integration for a particular site/chatbot exceeds €25 per month (PRO plan). In this case, a review of fees for future use of the service or termination/limitation of certain functionality may apply.
4. Any other situation that could limit the provision of the Service to all users.

Disclaimer

Please note that this is a beta version of the Botsurfer web tool (website), which is still undergoing extensive development, whether related to UI changes or feature changes, prior to the final release, after which feature development will be more linear (i.e. features will only be added, not removed or extensively changed).

The Website, its software, and all content contained therein are provided as is and as available. The Company makes no warranties, express or implied, as to the suitability or usability of the Website, its software or any of its content.

The Company shall not be liable for any loss, whether direct, indirect, special or consequential, suffered by any party as a result of the use of the Service, its software or its content.

In particular, the Company shall not be liable for any disruption of functionality caused by third party outages and/or changes in the technical means of connection to such third parties.

The main third parties affected are Meta Platforms, Inc. and the services provided by it (Graph API, Messenger API, Marketing API) and OpenAI, Inc. and the services provided by it (GPT API).

Any downloading, uploading or synchronization of data on the website is done at the user's own risk and the user is solely responsible for any damage to the computer system or loss of data or monetary loss resulting from these activities.

If you experience any errors, malfunctions, lack of functionality or other problems on the Website, please notify us immediately so that we can correct them accordingly. Your feedback helps us make the Botsurfer service a better product and we greatly appreciate it.

The Terms of Service may change from time to time.
Any updates will be posted on this page.
